Privacy Policy

This page explains what personal data we collect through fcareurope.com, what we use it for and what your rights are. We apply Regulation (EU) 2016/679, the General Data Protection Regulation (GDPR), and Spanish Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGD).

1. Who the data controller is

FCAR Europe is a brand of EFITALLER AUTOMOCIÓN SL, which is the controller of your data:

2. What data we process

Only the data you give us, and it is almost always business data: this website is aimed at workshops, companies and distributors.

  • Website forms (contact, quote request, product pages, become a distributor, distributor qualification and call booking): your name, email, phone, company, country, province or region, your message and the products you are interested in. In the qualification form, also information about your company and its commercial activity; in the call booking, the day and time you want us to call you.
  • Website chat: what you write in the conversation and, if you want us to contact you, your name, email, phone, company and location.
  • Technical data of the submission: the IP address and browser from which you send a form or a chat message, which we use to detect spam and abuse.
  • Emails and calls: whatever you tell us when you write to or call us.

We do not ask for special categories of data (health, beliefs, etc.). If you give us someone else's data, for example a colleague's, please make sure they agree.

To count visits we use our own anonymous measurement, without cookies and without storing the IP address, which does not reveal who you are. We explain it in the cookie policy.

3. What we use it for and on what legal basis

  • Handling your request: preparing the quote, giving you the information you ask for, calling you at the time you booked or assessing your application to become a distributor. Legal basis: taking steps at your request prior to entering into a contract (Art. 6.1.b GDPR).
  • Managing the relationship if you are a customer or distributor: sale, delivery, installation, training, technical support and warranty. Legal basis: performance of the contract (Art. 6.1.b GDPR) and compliance with legal obligations, such as tax obligations (Art. 6.1.c GDPR).
  • Commercial follow-up: sending you information and reminders about FCAR equipment related to your request. Legal basis: our legitimate interest in following up with companies that have shown interest in our products (Art. 6.1.f GDPR) and, when you tell us so (for example, by asking us to get back to you later), your consent. You can object at any time by replying to the email or writing to info@fcareurope.com.
  • Protecting the website: preventing spam, automated submissions and abuse of the forms and the chat. Legal basis: our legitimate interest in the security of the site (Art. 6.1.f GDPR).

The contact details requested in the forms are necessary to handle the request: without an email or a phone number we cannot reply to you.

About the chat. The website chat is an automated assistant that answers questions about the equipment. It does not make decisions about you or build profiles: if you leave your details, a person from our team will contact you. To generate the answers, the text of the conversation is sent to Google (Gemini service). The conversation is only kept for the duration of your visit; if you leave your details, we store your request with a summary of what you asked for. We recommend that you do not write unnecessary personal data in the chat.

4. Who your data is shared with

  • The official distributor for your area. In some areas (currently parts of Spain, Germany, Austria and southern France) FCAR Europe works with authorised distributors. If you ask us for information or a quote from one of these areas, we pass your request on to them so that they can deal with you directly.
  • Service providers who may only use the data on our instructions: Clientify (the CRM where we manage business contacts), website hosting and email, Cloudflare (anti-spam check on the forms) and Google (chat answers).
  • Public authorities, courts and law enforcement, only when required by law.

We do not sell your data or share it for advertising purposes.

Transfers outside the European Union. Cloudflare and Google may process data in the United States. Both companies are certified under the EU-U.S. Data Privacy Framework and apply the standard contractual clauses approved by the European Commission.

5. How long we keep it

  • Requests received through the website (forms and chat): three years from receipt, after which they are deleted automatically. The IP address and browser are deleted earlier, after twelve months.
  • Contacts in our CRM: for as long as the business relationship lasts or until you object or ask us to delete them.
  • Customers: for the duration of the relationship and then for the periods required by law (for example, tax and commercial legislation) and those of the warranty and any claims.
  • Visit measurement: twelve months, and it is anonymous.

6. Your rights

You can ask us at any time to:

  • Access your data and find out how we process it.
  • Correct it if it is inaccurate.
  • Delete it.
  • Stop processing it, especially for marketing communications.
  • Restrict its processing.
  • Receive it in a format you can take to another company (portability).
  • Withdraw any consent you have given, without affecting what was done before.

Write to info@fcareurope.com or by post to EFITALLER AUTOMOCIÓN SL, Avenida Doña Ana, Nave 6, 29130 Alhaurín de la Torre (Málaga, Spain), stating which right you wish to exercise. If we have reasonable doubts about your identity, we may ask you for additional information to confirm it. We will reply within one month.

If you believe we have not handled your data properly, you can lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) or with the data protection authority in your country.

7. Security

We apply technical and organisational measures to protect your data: the website always runs over an encrypted connection (HTTPS), access to requests is restricted to the people who handle them, and data is deleted automatically when the periods above expire.

8. Cookies

This website only uses technical storage, with no analytics or advertising cookies. We explain it in the cookie policy.

9. Changes to this policy

If what we do with data changes, we will update this page and its date. If the change is significant, we will announce it visibly on the website.
